What Is An EB-1 Visa?

Applying for an EB-1 Visa might be intimidating at first.

Moving to the United States requires a lot of work and dedication. Obtaining a work visa is no easy task, especially if you do not know the requirements. Proving eligibility might be easier if you have an attorney to lead the way. 

Extraordinary Immigration implies that if you want to obtain an EB-1 Visa, you must meet relevant criteria or have at least a one-time achievement such as Pulitzer, Oscar, or Olympic medal. The main criteria are that you have extraordinary ability and deserve to receive your EB-1 Visa due to your high performance in your field.

Suppose you attained extraordinary success in your field and plan to immigrate to the U.S. to continue increasing your achievements. In that case, the following information could be helpful in your pursuit of obtaining an EB-1 Visa.

EB-1A – Extraordinary Ability 

To obtain an EB-1A Visa, you must prove that you attain an extraordinary ability in the practices of arts, education, business, or athletic fields by providing proof of national or international acclaim. There are ten eligibility criteria for this type of visa, but you need to meet only three to prove eligibility. Regardless of your work field, you must have performed in leading roles at a distinguished organization and have a higher salary than your co-workers.

In other situations, you must prove that you contributed significantly to original artistic, scholarly or scientific work and had a particular impact in your field. On the other hand, if you have a single extraordinary achievement such as an Academy Award, a Pulitzer Prize, or an Olympic Medal, you will be considered eligible for the EB-1A Visa for Extraordinary Ability. To apply for this visa, you must fill out Form I-140, Petition for Alien Worker. 

EB-1B – Outstanding Professors and Research

You must meet two out of six requirements for the EB-1B Visa. Suppose you can demonstrate that you have international recognition for outstanding achievement in your academic field and at least three years of experience in teaching or research in your specific area. 

In that case, you could also be eligible for the EB-1B Visa. Some of the criteria you should meet before applying for the EB-1B Visa require you to belong to specific distinguished associations or own original scientific research and scholarly works. Having material published in professional publications or authorship of scholarly books from your field is another criterion that will prove your eligibility for the EB-1B Visa.

You will need to fill the Form I-140 and prove the reason for your immigration to the U.S. is to pursue tenure at a university or any institution of higher education. You must submit an annual report, federal income tax return, or an audited financial statement demonstrating that your wage can be paid. 

EB-1C – Certain Multinational Managers or Executive 

The EB-1C Visa requires you to demonstrate that you have a qualifying relationship with the company or business entity you have worked with for at least one year. The company must provide you with proof that they intend to employ you in a managerial or executive position. To get this visa, you must complete Form I-140, Petition for Alien Worker, and demonstrate that your employer can pay your wage for a long time.
